An Oath is sometimes required in legal documents, for example, Affidavits, Statutory Declarations, council documents (such as transfer of burial rights) and Insolvency Forms.

These must be sworn on Oath. Sworn on the Bible or Koran (Quran) in front of a solicitor or commissioner of oaths.

A Statutory Declaration, in conveyancing, is a document drafted where there is a title defect and this is used as part of the process to rectify the issue.

A statutory declaration is a legal document. You should not perjure yourself by swearing one which contains incorrect information.

A Statutory Declaration can also be required in other instances, such as when you are a landlord dealing with release of bonds held in a deposit scheme (TDS).

Statutory declarations are often required when you are getting married abroad.

By swearing the Statutory Declaration, you are confirming that the contents of the same are true and correct. You will need to be present at the swearing and must take relevant current, original ID.

You will need to see an independent solicitor, who did not draft the document, and there is a standard fee payable for the swearing. The document can then be relied upon legally.

You will meet face to face with the solicitor and will need to place your hand on a Bible or Quran and say a few words.

There is a minimal fee (£10 to £20) charged by the solicitor for this service. Solicitors regulators do not allow them to charge more, and this charge has not increased in the last 20 years, regardless of inflation.
